1. General information and roles
The digital memorial service you are accessing is a technological tool provided by Lumina Memorials (hereinafter, the “Provider”), but contracted and managed by the Funeral Home entity that provided you with access (hereinafter, the “Data Controller”).
- The Data Controller (Funeral Home): This is the entity that determines the purposes and means of processing your personal data.
- The Provider (Lumina Memorials): Acts exclusively as a Data Processor, strictly following the instructions of the Data Controller to provide the technological infrastructure.
2. Purpose of processing
The purpose of the data processing is the creation of a digital memorial video. Data (photographs, videos, messages) provided by families and guests is stored temporarily under strict security measures. By uploading content, you warrant that you possess all necessary image rights and intellectual property rights required for such processing.
3. Retention and deletion (important)
This service has a limited duration of thirty (30) calendar days from the moment the capsule is activated.
- Download responsibility: The family (the account administrator) is solely responsible for downloading the final memorial video and/or collected files before the deadline expires.
- Irreversible deletion: Once the period has elapsed, the system will automatically and permanently delete all multimedia content. Lumina Memorials does not retain backup copies after this process.
4. Exercise of rights (data protection)
To exercise your rights (access, rectification, erasure, objection, restriction, and portability), you must first contact the Data Controller (your funeral home) through the customer support channels provided to you at the time of contracting the service.
If you do not have this information, you may contact Lumina Memorials at info@luminamemorials.com, providing the following mandatory details:
- Name of the client Funeral Home.
- Capsule ID or link.
- A detailed description of your request.
The Provider will forward your request to the Data Controller for processing within the legally established timeframes.
5. Content standards and liability
You and your guests act as administrators and moderators of the shared content. The Provider is not responsible for the nature of the files uploaded, reserving the right to remove any content that infringes upon the law or third-party rights upon receiving notice of its illegality.
6. Acceptance of terms
By accessing and using this platform, you declare that you:
- Are at least 14 years of age (or have the authorization of your legal guardians).
- Have read and understood that Lumina Memorials is a technological service provider and that legal responsibility rests with the funeral entity that granted you access to the service.
- Accept the terms regarding the automatic deletion of all information after 30 days.
7. Governing law and jurisdiction
These Terms of Service and Privacy Policy shall be governed by and construed in accordance with the laws of Spain. Any dispute, controversy, or claim arising out of or in connection with this service shall be subject to the exclusive jurisdiction of the courts and tribunals of the city of Barcelona, Spain, to the exclusion of any other jurisdiction.
